Terms of Use

These Terms of Use (“Terms”) govern your use of the MyDietAI mobile application (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

Medical disclaimer. MyDietAI is a nutrition tracking and informational tool. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical or dietary advice. Nutrition values and AI-generated guidance are estimates and may be inaccurate. Always consult a qualified healthcare professional before making decisions about your diet, health, or any medical condition. If you are experiencing a medical emergency, call your local emergency number. If you are struggling with disordered eating or your relationship with food, please seek support from a qualified professional — the App includes a link to mental health resources.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. By using the App, you confirm that you meet this requirement.

2. The Service

The App lets you log food, track nutrition, read activity data from Apple Health, capture food photos for AI-assisted nutrition estimates, and chat with an AI nutrition advisor. Some features require a paid subscription (see Section 4).

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

4. Subscriptions & Billing

MyDietAI offers auto-renewable subscriptions (“MyDietAI Pro”) on a weekly, monthly, or annual basis. The following terms apply to purchases made through the Apple App Store:

Payment is charged to your Apple ID account at confirmation of purchase.
Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
You can manage or cancel your subscription at any time in your Apple ID Account Settings in the App Store after purchase.
Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription.
Prices are shown in the App and may vary by region. Refunds are handled by Apple in accordance with App Store policies.

5. Acceptable Use

You agree not to misuse the App, including by: attempting to reverse-engineer or disrupt it; using it for unlawful purposes; uploading content you have no right to; or submitting content that is harmful, abusive, or violates others’ rights.

6. Your Content

You retain ownership of the food photos, logs, and messages you submit (“Your Content”). You grant us a limited license to process Your Content solely to operate and provide the App (including sending it to our AI provider for analysis), as described in our Privacy Policy.

7. AI-Generated Content

The App uses artificial intelligence to estimate nutrition and generate responses. AI output may be incomplete, inaccurate, or unsuitable for your circumstances. You are responsible for evaluating its accuracy and appropriateness. Do not rely on it as professional, medical, or nutritional advice.

8. Intellectual Property

The App, including its design, software, and branding, is owned by MyDietAI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or content except the limited right to use the App.

9. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that nutrition estimates will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, MyDietAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your reliance on nutrition data or AI guidance, or your use of (or inability to use) the App.

11. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App and delete your account at any time.

12. Changes

We may update these Terms or the App from time to time. We will revise the “Last updated” date, and continued use of the App after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of New Zealand, without regard to its conflict-of-laws rules, except where local consumer-protection laws grant you additional rights.
